Privacy policy and cookies on the www.kolsquare.com website

Kolsquare thanks you for visiting its Site. The users of the Site (the " Users ") will find in the present confidentiality policy (the " Confidentiality Policy ") the rules that Kolsquare applies during the collection and use of information allowing the identification, directly or indirectly, of a User (the " Personal Data ").

By accessing and using the Site, the User agrees to be bound by the Privacy Policy, which may be modified or updated at any time without prior notice. Any changes or updates will be posted on the Site. If the modifications of the Confidentiality Policy concern elements for which the consent of the User had been required, Kolsquare will inform the User in order to obtain his consent again.

The Privacy Policy informs Users of the conditions of use of their Personal Data by Kolsquare when the User visits the Site or accepts cookies.

ARTICLE 1. HOW DOES KOLSQUARE USE THE DATA AND WHY?

Kolsquare is responsible for the processing of Users' Personal Data and has appointed a data protection representative to the Commission Nationale de l'Informatique et des Libertés (the " CNIL ").

Personal Data is used in accordance with Law no. 78-17 of 6 January 1978 relating to information technology, files and freedoms, known as "Informatique et Libertés", as well as Regulation (EU) no. 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of Personal Data and on the free movement of such data (together, the " Applicable Regulations ").

Kolsquare undertakes to collect and process Users' Personal Data in a fair and lawful manner and to respect their rights.

The Personal Data of Users is collected to respond to the request for information made from the Site by the User, in particular to offer a demonstration of the platform published by Kolsquare as well as to allow Users to download guides and studies prepared by Kolsquare and to subscribe to the Kolsquare newsletter (legal basis: consent).

ARTICLE 2. WHAT DATA IS COLLECTED BY KOLSQUARE?

Users must provide their Personal Data accurately, truthfully and truly.

Kolsquare may collect data relating to the identity of the User (title, surname and forename), his professional details (email address and telephone number), and, optionally, the company in which he works and the position he holds.

Kolsquare may collect this data when Users use a contact form on the Site.

ARTICLE 3. PROTECTION, STORAGE AND DELETION OF PERSONAL DATA

The Personal Data provided is hosted by OVH and is accessible to the marketing and sales departments.

Kolsquare makes every effort to avoid any interference with the Personal Data of other Users, such as loss, misappropriation, intrusion, unauthorised disclosure, alteration or destruction.

The Personal Data is kept for a maximum period of three (3) years from the last contact, except in the event that the Users of the Site have created an account on the Kolsquare platform. In this case, the Personal Data will be treated in accordance with the confidentiality policy of the Kolsquare platform.

ARTICLE 4. TRANSFER OF USERS' PERSONAL DATA

Kolsquare may transmit Users' Personal Data to its service providers, in particular :

  • OVH, which hosts the Personal Data and whose servers are located in France;
  • Hubspot, which is the customer relationship management and emailing tool used by Kolsquare. The data is used to personalise and send communications to Users. Hubspot's servers are located in the United States. To ensure the protection of Personal Data of Users, Kolsquare has concluded the standard contractual clauses of the European Commission with Hubspot;
  • Marketo, which is a marketing tool published by Adobe and used by Kolsquare, whose servers are located in the United States. To ensure the protection of Users' Personal Data, Kolsquare has also concluded standard contractual clauses with Adobe.

Kolsquare undertakes not to communicate, assign or transfer to third parties the Personal Data of Users without their express consent but may communicate them if required by law or by judicial or administrative request.

ARTICLE 5. WHAT RIGHTS DO USERS HAVE OVER THEIR DATA?

Users have the following rights with regard to their Personal Data: the right to access, modify and request the deletion of their Personal Data, the right to obtain communication thereof in a structured and readable format (except in the event of a legitimate impediment). Users may also ask Kolsquare to limit the processing of their Personal Data, or to oppose such processing, including in the case of profiling.

Users may lodge a complaint with the CNIL and define directives relating to their digital will.

Where Users have given their consent, they may withdraw it at any time, it being specified that any prior processing of their Personal Data will remain lawful.

In accordance with the Applicable Regulations, Kolsquare will have one month to reply to any request, subject to a possible extension, and reserves the right to oppose any request considered abusive due to its repetitive nature.

ARTICLE 6.COOKIES

6.1 What is a cookie?

A cookie is a file that may be saved on the hard disk of your terminal when the User consults the Site. These small files may contain, for example, the browser language and the User's preferences.

Kolsquare may place cookies on Users' terminals in order to enable them to browse the Site under optimum conditions and to restore their preferences when they are connected via their usual terminal, or to compile statistics.

6.2 Cookies used by Kolsquare via the website

Kolsquare uses :

  • browsing cookies, which are necessary for the proper technical operation of the Site, as they enable content to be displayed optimally from each terminal and to apply security parameters ("_cfuid" cookies), which expire when the User closes the browser;
  • functional cookies, which are not essential to the proper functioning of the Site but optimise the experience on the Site by enabling the Site's presentations to be adapted to the User's terminal and by saving the User's choice as to the deposit of cookies. This cookie will be kept for one year;
  • analytical and audience measurement cookies, which enable us to track the browsing habits of Users for optimisation purposes.
  • Google Analytics is a web analytics service provided by Google to help improve the operation of the Site. Google Analytics uses the data collected, in particular the number of visitors, the origin and details of the pages visited, to monitor and study the use of the Site and to prepare reports on activities. 6.3 Traffic data

Traffic data is generated when Users' terminals are connected to the Internet and the Site.

This data may be used for statistical purposes in order to analyse traffic on the Site and to improve it by adapting it to the needs of Users. Kolsquare never uses traffic data by name.

7. GMAIL MAILBOX SYNCHRONISATION

Through our Platform, Users can synchronise their Gmail account with the Platform's messaging functionality, in order to contact KOLs from their own Gmail address.

In the event of Gmail email synchronisation, the email interface accessible on the Platform will be a replica of the User's Gmail account. Thus, the User will be able to use his/her Gmail account via the Platform in order to facilitate communications between KOLs and Customers. All emails will remain accessible on the User's Gmail account.

In this case, Kolsquare does not transfer the data of Users accessible and stored in their Gmail accounts to its own servers, and does not transfer or sell the Data of Users to third parties, (including for advertising or marketing purposes). Users' Gmail Data will only be used to authenticate Users and allow them to send emails.

Kolsquare respects the confidentiality of emails sent via the Platform and Kolsquare and its employees will not disclose or read the content of these emails, except with the permission of Users to resolve technical incidents in particular.

If the Users do not synchronise their Gmail account with the Platform, Kolsquare will not have access to the Users' mailbox.

8. DATA SHARING WITH GOOGLE

The use and the transfer by Kolsquare to any other application of the information coming from the APIs of Google will be in conformity with the rules relating to the data of the users of the API services of Google, including the Limited Terms of Use.
